Which general terms and conditions apply?

  1. Applicability of these terms and conditions
    These General Terms and Conditions for Visitors apply to every agreement between Blue BV (here after referred to as ‘World of Dinos’) and a visitor.
  1. Definitions
    In these General Terms and Conditions for Visitors, we mean by:
    Visitor: the person who enters an agreement with World of Dinos to attend the exhibition which is organized by or on behalf of World of Dinos.
    Third-party producer: the direct or indirect third party which is involved as an organization or (executive) producer of the exhibition.
    Third party ticket seller: the third party designated by or on behalf of World of Dinos as the official ticket seller.
    Blue BV, also trading under the name World of Dinos, The Netherlands Chamber of Commerce number 28085915, Zijldijk 24-B, 2352 AB Leiderdorp.
    Service fee: additional fee (in addition to the ticket price) that World of Dinos or a third-party ticket seller may charge to cover transaction and other costs.
    Location: the location rented by World of Dinos or the third-part producer where the exhibition will take place.
    Admission ticket: A physical or digital document that gives the right to access the exhibition, provided with a unique code that can be read by a scanner.
    Exhibition: the exhibition organized by World of Dinos that takes place in a location.
  2. Admission tickets
    a. The agreement between World of Dinos and the visitor is established when the visitor purchases an admission ticket for the exhibition. Tickets can be purchased either through the World of Dinos website or third-party ticket sellers.
    b. An admission ticket is issued once and entitles one visitor to access the exhibition.
    c. The person who first shows the admission ticket at the entrance will receive access to the exhibition. World of Dinos assumes that the person is also the owner of the admission ticket.
    d. World of Dinos is not obligated to investigate the validity period of the admission ticket and/or the identity of the holder.
    e. As soon as the admission ticket has electronically or physically been made available to the visitor, the visitor bears the risk of loss, theft, damage or misusage of the admission ticket. World of Dinos can only guarantee the validity of the admission ticket if the admission ticket has been purchased from World of Dinos or a third party ticket seller. The burden of proof in this case rests on the visitor.
    f. If the visitor has not received an admission ticket (not even in the spam box of the visitors email account) while the visitor has demonstrably paid, the visitor must report this to World of Dinos at least 24 hours before visiting the exhibition. In the event the admission ticket has been purchased from World of Dinos or a third party ticket seller, the visitor will receive a new admission ticket and the old admission ticket will become invalid. The visitor bears the burden of proof that he or she has purchased the admission ticket from World of Dinos or a third party ticket seller. In the absence of proof, World of Dinos is not obligated to provide a new admission ticket for the visitor.
    g. World of Dinos has the right to set a maximum number of tickets to be ordered per visitor.
    h. Tickets cannot be returned or exchanged unless these conditions provide otherwise.

 

  1. Sale and transfer of the admission ticket
    a. The visitor is obligated to keep the admission ticket to themselves. Resale is not allowed. The visitor may give the tickets purchased by him or her to a third party if he or she is unable to attend.
    b. The visitor may not advertise the exhibition with the intention to (re)sell the admission ticket.
    c. In the event the visitor gives his or her admission ticket to a third party, the visitor is obligated to inform the relevant third party of these General Terms and Conditions for Visitors and, where possible, to provide them physically or electronically. The visitor guarantees that the third party complies with the conditions.
    d. World of Dinos is entitled to invalidate an admission ticket that has been resold or used for commercial purposes in violation of these General Terms and Conditions for Visitors. An invalid admission ticket does not entitle you to access the exhibition.

 

  1. House rules of the location: times of visit
    a. Due to the visit to the location, any other additional terms, conditions and house rules of the location apply in addition to these General Visitor Terms and Conditions.
    b. The visitor is obligated to follow up the instructions of the World of Dinos employees and employees of the location.
    c. The visitor is obligated to cooperate with frisking (including any checking of bags) when entering the location. If the visitor refuses, World of Dinos can deny access to the location and/or the exhibition without the right to a refund.
    d. When the visitor arrives at the exhibition any time other than the timeslot for which the admission ticket was purchased, the visitor must follow the instructions of the World of Dinos employees. The visitor ill only be given access to the exhibition at a time to be determined by World of Dinos due to the restrictions on visitor numbers.
    e. Entire or partial registration of the exhibition, including photography, filming and taking sound and/or image recordings with any device, is not permitted.
    f. The location and/or World of Dinos may have camera surveillance in and around the location due to security reasons. Camera images are not kept longer than strictly necessary.

    6. Rights of World of Dinos.
    a. If the visitor violates one or more provisions of these General Terms and Conditions for Visitors, the visitor is legally in default without further notice of default being required. In that case, World of Dinos is entitled to:
    – Dissolve the purchased agreement with immediate effect and without judicial intervention; and
    – Refuse the visitor (further) access to the exhibition, for example by invalidating the admission ticket, without the visitor being entitles to a refund.
    b. An invalid admission ticket does not (no longer) entitle you to access the exhibition.
    c. World of Dinos is allowed to take audio or video recordings of the exhibition for promotional purposes, including social media and advertising campaigns. The visitor may occur occasionally recognizable in the image.

    7. Force majeure

    a. In addition to article 6:75 of the Dutch Civil Code, a shortcoming in the fulfillment by World of Dinos cannot be attributed to it in the event of force majeure. Force majeure also includes any circumstance beyond the control of World of Dinos – even if this could have been foreseen as a possibility at the time of the conclusion of the agreement – that temporarily or permanently prevents fulfillment of the agreement, including:
    1. Strike, roadblocks, public transport strike or weather conditions in public transport;
    2. Terrorist attacks, war, riots, fire or actions by the police, army and/or fire brigade;
    3. A government-imposed lockdown or other restrictive measure to protect public health;
    4. Illness and/or cancellation of those involved and/or organizer;
    5. Nuisance and/or unlawful acts caused by third parties, including other visitors;
    6. Failure of facilities to function properly due to a calamity, maintenance work or other events in the location.

B. In case of force majeure, World of Dinos has the right to offer replaced data or to cancel the exhibition.

C. Although World of Dinos will make every effort to inform the visitor by e-mail of any cancellation, World of Dinos cannot guarantee the visitors will be individually informed of the cancellation prior to the date of visit of the exhibition. World of Dinos is not liable for travel or other costs that the visitor has already incurred in connection with a planned visit to the exhibition.

D. When the event occurs World of Dinos decides to cancel the exhibition;
World of Dinos (or, where appropriate, the third party ticket seller on behalf of World of Dinos) will refund the price of the admission ticket to the visitor. Refunds will not be made later than three months after the date of the cancelled exhibition. Tickets purchased electronically are automatically declared invalid and therefore will not be valid for any future editions of the exhibition. In the event of cancellation, physically purchased admission tickets can be returned to the location where the admission ticket was purchased.

E. In the event that World of Dinos decides to move the exhibition to other dates, the visitor will automatically be given the option to rebook the tickets to these new dates. If the visitor is unable or unwilling to visit the exhibition on the new dates, the visitor has the right to return the admission ticket to the third party ticket seller against a refund of the fee paid by the visitor to World of Dinos or to the third party ticket seller. This refund will only happens if the visitor can hand over a forehanded, valid and undamaged admission ticket. If the exhibition is moved up to a later date than the original date, the visitor can only claim a refund if he or she has handed in the admission ticket to the party from whom the admission ticket was purchased within six weeks of the announcement of the new dates of the exhibition. If the visitor does not submit a request for a refund within those six weeks, this will be considered tacit consent to the shift and the right to a refund will lapse..

F. Only the visitor who is a consumer and who has purchased the admission ticket from World of Dinos or a third party ticket seller, is entitles to a refund of the service costs in time of the event of a force majeure. World of Dinos is not obligated to compensate other damage in the event of force majeure, even if World of Dinos benefits from any advantage as a result of the force majeure. The visitor cannot claim access to another exhibition or production.

  1. Liability

A. World of Dinos is only liable for any property and/ or consequential damage or injury suffered by the visitor, if the damage is caused by intent or willful recklessness on the part of World of Dinos and/or third parties engaged by World of Dinos. The compensation is never higher than the amount that the insurer of World of Dinos pays out in the relevant case. If the insurer does not pays for any reason, World of Dinos’ liability is limited to 25.000 euro per event or series of related events. Claims for damage caused by the venue must be made to the venue. The visitor declares that he or she is aware and agrees to a visit to the exhibition is at all time at its own risk. This also applies – but not exclusively – to the use of the present playground equipment including bouncy castles. Parents are responsible for supervising their children.

B. World of Dinos’ liability is in any case excluded for:
– Damage as a result of the actions of third parties, including tenants of other areas of the location and the persons engaged by these third parties;
– Damage as a result of not following instructions given by World of Dinos employees;
– Damage resulting from non-compliance with the house rules of World of Dinos and/or the location;
– (consequential) damage as a result of unforeseeable changes in the starting and closing times of the exhibition to which the agreement between World of Dinos and the visitor relates;
– Personal injury that is reasonably attributable to the location;
– Damage in any way caused by other visitors.

C. Offers, (program) announcements, announcements, prices or other information provided by or on behalf of World of Dinos about an exhibition are without obligation. World of Dinos is not liable for any errors by World of Dinos or third parties in that information, nor for errors made in the (pre-)sale of tickets by third parties, including the third party ticket seller.

D. The following circumstances do not constitute ground for a refund of the admission ticket:
– Last minute changes to the content of the exhibition.
– Last minute changes or disruptions to the kidzone attractions.

  1. Personal data

The personal data of the visitor who registers World of Dinos or third party ticket seller in connection with the issuance of an admission ticket will be included in the records of World of Dinos and/or the third party ticket seller. World of Dinos processes personal data in accordance with applicable laws and regulations.

  1. Final provisions
    a. The insignificance of any provision of these General Terms and Conditions for Visitors does not affect the validity of the other provisions.
    b. Dutch law applies to these General Terms and Conditions for Visitors and to the agreement that exists between the visitor and World of Dinos.
    c. Any conflict arising from an agreement between World of Dinos and the visitor will be settles exclusively by the competent court of the registered office of World of Dinos, unless the law expressly provides otherwise.
